1. Scope

These Terms & Conditions ("Terms") govern all orders placed through the dos besos online store ("we," "us," "our") by both consumers and business customers. By placing an order with us, you agree to be bound by these Terms as they stand at the time of your order. We reserve the right to amend these Terms for future orders; any changes will not affect orders already placed.

3. Conclusion of contract

The product listings displayed in our online store do not constitute legally binding offers on our part. They are a non-binding invitation for you to place an order.

When you click the order button at the end of the checkout process, you are submitting a binding offer to purchase the goods contained in your shopping cart. Receiving an automatic confirmation of your order (for example, by email) only confirms that we have received your order — it does not yet constitute our acceptance of your offer.

A contract is only concluded once we accept your order, which we do either by sending you a separate order acceptance email or by shipping the ordered goods to you.

4. Prices and shipping costs

All prices shown on our product pages are stated in Euros (EUR) and include statutory value-added tax (VAT) as well as any other price components required by law.

These prices do not necessarily include shipping costs. Applicable shipping costs are calculated based on your order and delivery address and are clearly shown to you during the checkout process, before you place your order and become bound to pay.

5. Payment

The payment methods available to you are presented during the checkout process. Unless we have agreed otherwise with you, payment is due immediately upon conclusion of the contract.

We reserve the right to only offer certain payment methods depending on the outcome of a routine payment verification, where applicable.

6. Delivery

Unless otherwise stated on the product page or agreed with you individually, we aim to ship ordered goods within 3–7 working days of the conclusion of the contract or, where advance payment has been agreed, within 3–7 working days of receipt of full payment.

Should a delay occur beyond our control (for example, due to circumstances affecting our suppliers or carriers), we will inform you as soon as reasonably possible.

7. Retention of title

The delivered goods remain our property until full payment of the purchase price has been received.

8. Right of withdrawal and returns

If you are a consumer, you are entitled to the statutory right of withdrawal in connection with your purchase. The conditions, time limits, and procedure for exercising this right, as well as any exceptions that may apply, are set out in full in our Right of Withdrawal terms, which form part of these Terms. We encourage you to review that document before placing an order.

9. Warranty

We are subject to statutory warranty (legal guarantee) provisions. Nothing in these Terms limits or excludes any warranty rights you are entitled to under applicable law.

10. Dispute resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can access here: https://ec.europa.eu/consumers/odr/.

We are not obligated, and are not generally willing, to participate in dispute resolution proceedings before a consumer arbitration board.

11. Governing law

These Terms, and any contract concluded through our online store, are governed by the laws of Spain, without prejudice to any mandatory consumer protection provisions of the country in which you, as a consumer, have your habitual residence, where applicable.

Should any individual provision of these Terms be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions, which shall continue in full force and effect.
